ClockHealth Private Limited (hereafter referred to as “ClockHealth”, “Company”, “our”, “we”, “us”) develops and maintains digital care management platforms (hereafter referred to as the “Service Management Platform(s)” or “Platform(s)”) for service providers such as senior living centres, residences, institutions, and medical care providers (“Service Provider(s)” or “Customer(s)”) to, inter alia, manage their services and engage with individuals further availing the services from Service Provider (“End-Users”). We have created this privacy policy (“Privacy Policy”) in order to set out how we collect, use, and disclose personal information, including through our Platform or website located at http://clockhealth.com/ (the “Website”). The Website, together with the Platform and related services, except if specifically otherwise designated, shall be referred to herein as the “Services”. The privacy of our users is of great importance to us. By using the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.

What does this Privacy Policy cover?

This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals or information that is linked to an identifiable individual (“Personal Information”).

Service Providers can create authorised user accounts for the Team Users (authorised staff, employees, or associates of the Service Provider), to log in to and use the Platforms through appropriate interfaces. Service Providers can also create authorized user accounts for the End-Users (including residents/patrons/vendors and/or clients) to log in to and use their Platform through appropriate interfaces. Team Users and End-Users registered as users on the Platform are collectively referred to as “Authorized Users”. This Privacy Policy also applies to data collected/ provided by the Authorized Users to ClockHealth.

However, this Privacy Policy does not apply to the practices of third-parties that we do not own or control, including our Customers that subscribe to the Services. The Customers are responsible for their own privacy practices when using the Platform, including obtaining consent to collect, use and disclose End-Users’ Personal Information and/or personal health information as may be required by law.

1. Collection and Usage of Information

ClockHealth receives, collects and uses certain types of data or information from users. Our obligation or responsibility as a data fiduciary is limited to such instances where we specifically request for your Personal Information on our Platforms and does not include scenarios where you may, of your own accord, or on instructions of another party (such as Service Provider), upload personal data on the Platforms or share personal data with another person.

1.1. Team Users Information

Personal information such as name, email address and/or phone number can be added by Team Users (authorised staff, employees, or associates of the Service Provider) in the Platform to create Team Users accounts. It also includes other personally identifiable information that such users may choose to add to their user account profile. We use this Personal Information to uniquely identify each Team User as a user, authenticate their Account access, and provide them with access to the Platform and Services.

1.2. End Users Information

Personal information (including health information) may be added by the End-Users (Patient/ Patron) and/ or Team Users on the Platform to avail the services from the Service Provider. Further, such information may be entered manually and/or by syncing with a health monitoring device or from a third-party source. Team Users can also add administrative information about the services provided to End-Users (Residents/Patient/Patron) in the Platform.

The Customer is the controller of any information uploaded onto the Services (“Customer Data”), which is processed by ClockHealth as per the configuration settings and instructions of the Customer. The Customer alone decides which Authorized Users to create and terminate, and what access such Authorized Users have to add, update, delete, export or share the data. The Customer defines the policies, management and usage terms for Authorized Users of the Platform, and the Customer shall be solely responsible to ensure compliance by Authorized Users. A Customer can terminate Authorized User account at any time, and such user will no longer have further access to their information. The Customer shall have the sole discretion to decide whether such information to be shared with End-Users before termination.

1.3. Other Data
  • (i) Account Information: Information that the Customer provides to ClockHealth’s Platform at the time of setting up their account. This also includes information required for subscription and billing of the account. ClockHealth does not store the Customer’s credit card or other payment method information. The account information may also be used for automated system communications (email and other notifications), as per your notification settings, as part of the essential functioning of Services. Your contact information may also be used for customer support services, should you choose to avail of them. In addition, we may use your contact information to provide you with information about our products and services.

  • (ii) Operations Information: In order to enhance the Platform usage experience, ClockHealth uses non—personally identifiable information such as cookies, logs and analytics to enable certain functionality, improve services and monitor service usage. Information about browser, device, location, IP address, language settings, date and time of use may be captured in logs.

  • (iii) Third Party Services: The Customer may choose to configure and use certain third-party services within their Platform. For instance, the Customer may configure a third party payment gateway to accept payments through that gateway for services rendered to End-Users through the Platform.

  • (iv) Anonymized data: ClockHealth may analyze anonymized and aggregated data collected through the Services, for purposes of issue diagnostics, security assessment and monitoring, evaluating usage trends and requirement patterns and to measure the effectiveness of Services and content.

1.4. Website Information

We may also collect certain information from users of the Website through web forms that collect your first name, last name, email address, and phone number, and may also collect Internet addresses, time spent logged into the website, and other usage.

ClockHealth uses cookies (both session-based and persistent cookies) and similar technologies like single-pixel gifs, on the domains operated by ClockHealth for its Platforms and Website. We also use third party cookies of Google Analytics on our Website.

You may use browser settings to disable cookies when using our Services, however, it may result in the features of the Services not functioning properly. ClockHealth does not collect personal information about online activities of our Customers or visitors to our Website across third-party websites or other online services.

2. Disclosure of Information

2.1. We may disclose any information to government or law enforcement officials if we believe the same is required to comply with law enforcement and legal process; to prevent or stop any illegal, unethical, or legally actionable activity; to protect your, our or others’ rights and safety. Customers determine their own policies and management for the sharing and disclosure of their End Users’ data and shall ensure compliance with applicable legal requirements. ClockHealth will disclose Customer Data only as per the request and instructions of the Customer, whether as defined in terms of the service configuration that they apply in use of the Platform or by direct requests. Disclosure of Customer Data to Authorized Users of the Platform is determined by the Customer, while creating and configuring such Authorized User accounts. The Customer may also be able to request and view usage information of Authorized Users in the Customer’s Platform.

2.2.Sub-Processors: ClockHealth may utilize third-party services to further process the Personal Information and support our Services by providing hosting, storage, communications, webRTC and analytics services.

2.3. Third Party Services: Customers opting to configure certain third party services with their Platform should check the privacy policy and settings of such services and should understand what data may be shared between such third party services and ClockHealth, relevant to the integrated functioning.

2.4. If we (or substantially all of our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law.

3. Data Retention

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you for up to thirty (30) days. If a user is found to be in violation of the Terms of Use, ClockHealth reserve the right to deactivate or delete accounts of any user on the Platform. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law.
4. Transmission And Storage Security
All data is stored only on highly secure public cloud infrastructure platforms. We take all necessary measures to provide secure transmission of Personal Information before it is transferred across the internet from your personal computer or devices to our servers, and to secure such Personal Information stored on our systems. However, you should be aware of the possible risk involved in transmitting information over the internet, as no data transmission can be guaranteed to be 100% secure and of a risk that others could find a way to thwart our security systems. As a result, while we strive to protect your Personal Information, we cannot ensure or warrant the security and privacy of Personal Information you transmit to us, and you do so at your own risk.
5. Minor Users and Users with Disability
ClockHealth does not intend to and will not purposely collect, require or request Personal Information from persons under 18 years of age without permission from parent or legal guardian. If the user is a minor or a person with disability, he/she should not enter his/her Personal Information or use the Services in any way prior to obtaining the consent of the parent or legal guardian. Customers shall ensure that only parents or authorized guardians are allowed to operate Authorized User accounts on their behalf.

Our Website may contain links to third-party websites. The inclusion of any such link does not constitute an endorsement, authorization, or representation of any affiliation with the third party. We do not control, and are not responsible for, the content, policies, or practices of third-party websites. These websites may place their own cookies or other files on your device, collect data, or solicit personally identifiable information from you. We encourage you to read the privacy policies or statements of any third-party websites you visit.

7. Changes To This Policy

Please note that this Privacy Policy may change from time to time at any time without notice. In the event of any changes in our Privacy Policy, the updated version will be posted on the ClockHealth Website and take effect from the moment of posting.
